No, each individual recording is a "work" in and of itself, I believe.

Anyway.. yeah. You're right, but still, I'm really having a difficult time coping with this (money+music) thing..

One thing though, if you cut out more than 3/4 of a piece you can post it on the internet. In Belgium it is permitted to post short samples of intellectual property. I don't know about USA, but I think too.

Using material for private use is legal, only if the composer says no you can't use it. People may copy songs for private use, because it is impossible for the law to control this, even if the author objects to this. The composer may ask for money, but again it is impossible to control the copying of songs. Using songs for economical reasons is not allowed.

So posting music samples is allowed, that's what I think. Whole songs are rather not allowed.

Dammit, I had a page on US Copyright Law a while ago that stated the regulations regarding what constituted a legal smidgen of a work, but I can't find it. However, cutting out 3/4 sounds about right.

I think it's clear that YC does not qualify as an educational or scientific resource. :ninja:

If a work has been deployed publically, the author can't decline:

- The reproduction of articles or works of graphical art or short fragments out of works on paper or a similar portable object (eg transparants) with every photographical technique or others, only when reproduction is for illustration in educational or scientific research and doesn't do wrong to the exploitation of the work. Citation is needed.

(I don't know if "Music" is applicable here... I'm pretty sure it does)

- The use of music and graphical works in private!!! But the author has the right for a fee. (maybe you can say people on this site are all private users to this person Anders who has payed the fee for the work of Hamauzu, we're all friends!!!)

So the proof is here. If Anders has paid for that music and we are his friends, then he can post the whole song!

The citation of parts is legal, and not dependant of the approval of author and not dependant on a fee. The requirement is that the work has been deployed public and that the use is educational or scientific. (we could say that I'm educating someone about Hamauzu!).

The allowed size of the citation: using full part of poetry out of an album, a part of a musical composition to clarify the characteristics of a work of a composer are legal. With the citation you may not do damage to the moral rights of the composer.

What has been said here is applicable to plastic art, musical and choreography, not only literature. The citation may be done on book, film, radio, mp3...

They don't say what the size is of the short fragment. So I can let you hear half of the song.

Very important too:

Unfortunately, since YC is subject to US law (since the server it runs off resides in the US), Dutch law is probably irrelevant.

I was wondering, what about recordings that are the complete work that are posted upon the composer's website as a recording to listen to? Law befuddles and confuses me and I'm just trying to make sure before I post the link to Brian Balmages' Summer Dances that it's legal and I won't be penalized in any way for it.

It's fine if the recording in question is publicly accessible on the composer's own site.

If the original is under copyright, you MUST ask for permission to create any sort of arrangement.

So posting your arrangement is dependent on whether or not you received permission to create a subsidiary work from the original.

You cannot post the original if it is under copyright, even if you have made an arrangement. Making an arrangement does not suddenly give you "rights" to the original.
